TPD declaration for vaping products

Since 2016, the tobacco products directive (TPD) requires mandatory notification for the marketing of e-liquids containing nicotine. Each declared product must give:

• Recipe stating the different molecules present, the amount of which in the composition is > 0.1%,
• Report of emissions produced on the basis of reference documents,
• Associated analytical protocol,
• Reports confirming the declared results.

Every new recipe must be declared 6 months before its potential marketing. Since 1 January 2017, every product present on the market must have a notification certificate validated by the member state (EU).

Material safety data sheet (MSDS)

The MSDS (material safety data sheet) of a chemical product is a mandatory document. It contains the list of all the dangerous molecules (flammable or explosive) and the potential allergens present in the product.

A supplier, manufacturer or distributor must be able to provide the MSDS for its products on simple external request.

INRS and European poison control centre declarations

Every manufacturer, retailer or importer of chemical products must declare their products to an approved body.

In France, this declaration has to be made to INRS (Institut National de Recherche et de Sécurité) for transmission to the French poison control centres. In the case of selling the product abroad, on 1 January 2021, a notification per product and per European country will become mandatory.

The manufacturers or retailers of vaping products are also concerned by this measure. The same goes for other fields of activity like the agro-food or cosmetology sectors for example.
